It provides details about the personal information that we collect from you, how we use your personal information, and your rights regarding the personal information that we hold about you. Who is Liberum?

Liberum operates in the healthcare and digital sector providing independent medical education services. Liberum is made up of two legal companies: Liberum IME B.V and Liberum Independent Medical Education Limited. 

Liberum IME B.V has its main trading address at Schiphol Boulevard 359, 1118 BJ Schiphol, the Netherlands and is registered on the Trade Register of the Chamber of Commerce under number 82560447. Liberum Independent Medical Education Limited is registered in England and Wales under registration number 10276499 and has its registered office at Birchin Court 5th Floor, 19-25 Birchin Lane, London, England, EC3V 9DU. 

Data Controller

This privacy policy is issued on behalf of Liberum and its affiliated companies, so when we mentioned “Liberum”, “we”, “us”, or “our” in this privacy policy, we are referring to the relevant Liberum company responsible for processing your data. Liberum IME B.V and Liberum Independent Medical Education Limited are the data controllers and responsible for this website.

Data Processor

Liberum also conducts data processing activities on behalf of its financial supporters who will be the data controller for such activities. Where Liberum is a data processor, we may only process personal data in accordance with the controller’s documented instructions as set out in a data processing agreement or contractual arrangements. We may only transfer personal data out of the EEA and appoint sub-processors as permitted by the data processing agreement. Liberum is also given data sets for the purposes of research in a pseudonymised format which means the data subject will not be identifiable to Liberum because we have no access to the code that will re-identify the data.

Major Incidents and Health Emergencies. In circumstances where there is a virus or similar health and safety threat, to ensure the health and safety of all visitors, employees, or contractors, we may test your temperature by scanning individuals attending our offices with a thermal camera. No individual data will be retained or stored, but in line with our health and safety policy, if your temperature test indicates a higher-than-standard temperature, we may as a precaution ask you to leave or to retest for the protection of yourself and others in the interest of public health.

How we use your personal data

We will only use your personal data when the law allows us to. Most commonly, we will use your personal data in the following circumstances:

    • Where we need to perform a contract we are about to enter into or have entered into with you
    • Where it is necessary for our legitimate interests (or those of a third party) and your interests and fundamental rights do not override those interests
    • Where we need to comply with a legal or regulatory obligation
    • Where it is in the public interest to do so
    • With your explicit consent (which you may withdraw at any time) 
The personal data we may collect about you

Personal data means data which relate to a living individual who can be identified from those data, or from those data and other information which is in our possession, or is likely to come into our possession, and includes any expression of opinion about an individual and any indication of our intentions or the intentions of any other person in respect of the individual.   

We may collect, use, store, and transfer different kinds of personal data about you, which we have grouped together as follows:

    • Identity data include first name, maiden name, last name, username or similar identifier, marital status, emergency contacts, title, date of birth, profession, and gender
    • Contact data include billing address, delivery address, email address, and telephone numbers
    • Educational and biographical data include information about your work history, specialisms, qualifications, professional licence numbers for accredited bodies, progression, achievements, and extra-curricular activities
    • Financial data include bank account, payment card details and payments received
    • Transaction data include details about payments to and from you
    • Technical data include IP address, login data, browser type and version, time zone setting and location, browser plug-in types and versions, operating system and platform, and other technology on the devices you use to access our websites
    • Profile data include your interests, preferences, feedback, and any survey responses
    • Marketing and communications data include your preferences in receiving marketing and or newsletters from us and any communication preferences collected
    • Pseudonymised Data such as patient records not collected directly from a patient via a Healthcare Provider Organisation such as a hospital or doctor's general practice. There is no way for Liberum to re-identify this data as the re-identification criteria or "key" always remains with the Healthcare Provider Organisation in these circumstances.
    • Aggregated data are statistical or demographic data for any purpose and may be derived from your personal data but are not considered personal data by law, as these data do not directly or indirectly reveal your identity  
    • Subscription data include data collected from data agencies to whom you subscribe (e.g. Specialist Information)
    • Special categories of personal data include details about your race or ethnicity, religious or philosophical beliefs, sex life, sexual orientation, political opinions, trade union membership, health, and genetic and biometric data
    • Usage data include information about how you use our website
If you fail to provide personal data

Where we need to collect personal data by law, or under the terms of a contract we have with you, and you fail to provide that data when requested, we may not be able to perform the contract we have or are trying to enter into with you (e.g. to provide you with goods or services). In this case, we may have to cancel a product or service you have with us but we will notify you if this is the case at the time.

We have set out below, in a table format, a description of all the ways we plan to use your personal data, and which of the legal bases we rely on to do so. We have also identified what our legitimate interests are, where appropriate.
 
Note that we may process your Personal Data for more than one lawful ground, depending on the specific purpose for which we are using your data. Legitimate interest means the interest of our business in conducting and managing our business to enable us to give you the best service/product and the best and most secure experience. We make sure we consider and balance any potential impact on you (both positive and negative) and your rights before we process your personal data for our legitimate interests. We do not use your personal data for activities where our interests are overridden by the impact on you (unless we have your consent or are otherwise required or permitted to by law).

    • Professional advisers including lawyers, bankers, auditors, and insurers who provide consultancy, banking, legal, insurance, and accounting services
    • HM Revenue & Customs, regulators, and other authorities based in the EEA or outside the EEA who require reporting of processing activities in certain circumstances including the public interest
    • Marketing and social media tracking providers, including Survey Monkey Inc., Smart Monkey Marketing Limited, and The Rocket Science Group LLC (trading as MailChimp) for marketing activities and Runtime Collective Limited (trading as Crimson Hexagon and/or Brandwatch) for social media tracking

By providing us with your personal data you agree that Liberum may share personal data, on a confidential basis, to third-party individuals and organisations that assist us, including contractors, financial service providers, web hosts, and others as set out in the table and list above

International transfers

We may share your personal data with our subsidiary entities or with our associated companies within the OPEN Health Group for the use of central and corporate functions. This may involve transferring your data outside the EEA or the UK.

Whenever we transfer your personal data out of the EEA or the UK, we ensure a similar degree of protection is afforded by implementing at least one of the following safeguards:

We will implement further supplementary measures where possible and appropriate including technical, organisational, and contractual measures to augment the above-mentioned safeguards.

Post departure of the UK from the European Union, we will continue to take privacy of your data very seriously and manage your data according to the General Data Protection Regulations as they apply in the UK.

Data security

We have put in place appropriate safeguards to prevent your personal data from being accidentally lost, used or accessed in an unauthorised way, altered, or disclosed. In addition, we limit access to your personal data to those employees, agents, contractors, and other third parties who have a business need to know. If we share your personal data with our agents, contractors, and other third parties, we require they adhere to our Supplier Privacy and Security Requirements, which are available at www.liberumime.com/legal.

We have put in place procedures to deal with any suspected personal data breach and will notify you and any applicable regulator of a breach where we are legally required to do so.

Data retention: how long we use your personal data

We will only retain your personal data for as long as necessary to fulfil the purposes we collected it for, including for the purposes of satisfying any legal, accounting, or reporting requirements. We may retain your personal data for a longer period in the event of a complaint or if we reasonably believe there is a prospect of litigation in respect to our relationship with you.

To determine the appropriate retention period for personal data, we consider the amount, nature, and sensitivity of the personal data, the potential risk of harm from unauthorised use or disclosure of your personal data, the purposes for which we process your personal data and whether we can achieve those purposes through other means, and the applicable legal, regulatory, tax, accounting, or other requirements. We are required by law to keep basic information about our customers (including contact, identity, financial and transaction data) for at least 6 years after they cease being customers for legal and tax-reporting purposes. 

Details of retention periods for different aspects of your personal data are available in our retention policy, which you can request from us by contacting us (a subset of which is set out in the table Purposes for which we will use your personal data above).

In some circumstances we will anonymise your personal data or aggregate it (so that it can no longer be associated with you) for research or statistical purposes, in which case we may use this information indefinitely without further notice to you.

Your legal rights

Under certain circumstances, you have rights under data-protection laws in relation to your personal data. Where we have not collected the data directly from you, you have similar rights which may require you to communicate your request to the data controller from which Liberum received the data (Liberum would not have the ability to identify you should your data reside within a pseudonymised data set). You have the right to:

  • Request access to your personal data (commonly known as a “data subject access request” or “data portability request” or “right to know”). This enables you to receive a copy of the personal data we hold about you and to check that we are lawfully processing it.
  • Request correction of the personal data that we hold about you. This enables you to have any incomplete or inaccurate data we hold about you corrected, though we may need to verify the accuracy of the new data you provide to us.
  • Request restriction of processing of your personal data. This enables you to ask us to suspend the processing of your personal data in the following scenarios: (a) if you want us to establish the data’s accuracy; (b) where our use of the data is unlawful but you do not want us to erase it; (c) where you need us to hold the data even if we no longer require it as you need it to establish, exercise, or defend legal claims; or (d) you have objected to our use of your data but we need to verify whether we have overriding legitimate grounds to use it.
  • Request the transfer of your personal data to you or to a third party. We will provide to you, or a third party you have chosen, your personal data in a structured, commonly used, machine-readable format. Note that this right only applies to automated information which you initially provided consent for us to use or where we used the information to perform a contract with you.
  • Withdraw consent at any time where we are relying on consent to process your personal data. However, this will not affect the lawfulness of any processing carried out before you withdraw your consent. If you withdraw your consent, we may not be able to provide certain products or services to you. We will advise you if this is the case at the time you withdraw your consent.
  • Request for erasure or deletion of your personal data. This enables you to ask us to delete or remove personal data where there is no good reason for us continuing to process it. You also have the right to ask us to delete or remove your personal data where you have successfully exercised your right to object to processing (see below), where we may have processed your information unlawfully, or where we are required to erase your personal data to comply with local law. Note, however, that we may not always be able to comply with your request of erasure for specific legal reasons which will be notified to you, if applicable, at the time of your request.
  • Object to processing of your personal data where we are relying on a legitimate interest (or those of a third party) and there is something about your particular situation which makes you want to object to processing on this ground as you feel it impacts your fundamental rights and freedoms. You also have the right to object if we are processing your personal data for direct marketing purposes. In some cases, we may demonstrate that we have compelling legitimate grounds to process your information which overrides your rights and freedoms.

You will not have to pay a fee to access your personal data (or to exercise any of the other rights). However, we may charge a reasonable fee if your request is clearly unfounded, repetitive, or excessive. Alternatively, we may refuse to comply with your request in these circumstances.

We will not discriminate against you for exercising any of the above rights.

What we may need from you

We may need to request specific information from you to help us confirm your identity and ensure your right to access your personal data (or to exercise any of your other rights). This is a security measure to ensure that personal data are not disclosed to any person who has no right to receive it. We may also contact you to ask you for further information in relation to your request to speed up our response.

Time limit to respond

For Californian residents: We will acknowledge receipt of your request within 10 days and begin the process of verifying your request. Depending upon the sensitivity of the data collected and the nature of your request, we are required to verify your identity by matching at least 2 pieces of personal information or, for more sensitive information, 3 pieces of personal information. If you use an authorized agent, we will require written evidence of the authorization and identity.

For all other residents making a request under GDPR: We try to respond to all legitimate requests within 1 month. Occasionally it may take us longer than 1 month if your request is particularly complex or you have made a number of requests. In this case, we will notify you and keep you updated.
